Terms and Conditions

You must read these terms and conditions carefully prior to placing an order. By placing an order, you will be deemed to have read and accepted these terms and conditions and to be making an offer to purchase goods subject to these terms and conditions.

Unless otherwise agreed by the Company these Terms and Conditions shall override any terms and conditions stipulated or incorporated or referred to by the buyer and supersede any other verbal or written terms and conditions or representations.

 

Goods

All goods are described in full on our web site. It is the sole responsibility of the customer to ensure the suitability of the goods and access, prior to ordering. 

Images used are purely for illustrative purposes and may differ slightly from those delivered to the customer. 

All goods advertised on our website will be supplied subject to availability. If there is insufficient stock to honour your order, we will let you know as soon as possible and a full refund will be issued if payment in full has been already made.

Delivery

With the possible exception of bespoke or extra-large shipments, standard delivery is included within the price of the goods charged. This applies only to delivery addresses withing the UK Mainland. 

Deliveries will be made to the location set out in the original order and it is the responsibility of the customer to ensure that this information is correct at the time of ordering.

  

Any signature for the receipt of goods is view by couriers as confirmation that the goods are in perfect order. Therefore, customers should not sign for goods unless they have been inspected and their condition is viewed to be perfect. If goods are damaged, they can be refused at the point of delivery or signed for as damaged.

All goods must be thoroughly inspected by the customer on delivery and any damages be reported to the courier and subsequently to us immediately. We will not accept liability for any damage to goods or be required to provide any replacement goods to any customer who fails to notify us of damage withing the first 24 hours of accepting a delivery.

 

Returns Policy – Cancelled Goods, Refused Deliveries

This policy does not apply to items which are made bespoke to customer specifications. 

 

  • Goods sold in the UK may be returned for a refund within 14 days of delivery. 

  • For goods to be refunded, they must be in perfect, unused condition and in original packaging and with all components and accessories present. 

  • Goods must be returned at the expense of the customer and a 25% restocking fee will apply to all goods returned except those that may have been issued in error or the incorrect item has been supplied.

  • Goods must be returned by a registered courier and a receipt of delivery or signed for service used.

  • We will not accept responsibility for any damage or loss of goods that occur before they are returned to us, or when in transit.

  • A restocking fee will apply as soon as the order has been despatched.

  • Once received, the goods will be inspected to ensure all of the conditions mentioned above apply, and deductions made for any missing parts or repairs needed. 

  • No goods will be accepted for return after 14 days from delivery.

  • All returns must be arranged in writing by completing the Returns Submissions Form. Please do not arrange for return until you have confirmation from us, as the return address may be different from our head office. 

  • Any orders cancelled by the customer before delivery will be subject to a 25% handling and restocking fee.

Warranties

All goods will clearly show the warranty conditions for each item on the individual sales page.  If goods break down the customer must inform us immediately so that the warranty can be set in motion. Customers must complete all sections of the Warranty Claim Form and provide all information in order to activate any warranty.

Warranties are not held with the supplier but by the manufacturer. As a supplier, we will liaise on your behalf with the manufacturer and will endeavour to get your equipment back on track as soon as possible. However, we have no control over the time frame for the scheduling of engineer’s visits and shipping of replacement parts is out of our hands.

Warranties begin as soon as the goods are delivered. We accept no responsibility or liability for any loss of earnings, profit or consequential loss suffered by the customer as a result of the goods failure to be operational.

1 year Parts only warranty – goods provided with this warranty will need to be inspected by a qualified engineer of your choice who will diagnose the parts needed to fix the problem. A report on the faulty parts must be produced and this report, along with a warranty claim form must then be submitted to Fusion Catering Solutions as soon as possible. The replacement parts will then be sent to the customer who, on their receipt, must arrange for them to be fitted by a qualified engineer. Fusion Catering Solutions will not be liable for the cost of any inspection, call out fees or work undertaken by the engineer and will only bear the costs of replacement parts that are deemed to be faulty and not to have failed because of misuse or user error. (See warranty limitations).

Full Manufacturers Warranty – Goods that are covered by a full manufacturers warranty will have the duration of the warranty clearly stated withing the item specifications. Warranties may vary in their duration and conditions, according to the individual manufacturers term and conditions. Warranties do not include cover for faults that are deemed to have failed because of misuse or user error (see warranty limitations). 

A full warranty report must be made to Fusion Catering Solutions as soon as the fault is detected, and the equipment should no longer be kept in use. A warranty claim form MUST be fully completed and all information provided. Failure to provide serial numbers, model number and all other information will result in the warranty not being activated. A refundable deposit of £ will be taken at the time of the claim which will be refunded to the customer after the repairs have been made and Fusion Catering Solutions are satisfied that the costs of repair do fall within the warranty terms and conditions. 

In most cases, warranty work will take place in situ and goods do not have to be returned unless an engineer’s report specifies that this is required. 

Warranty Limitations

Your warranty may be negated in the following circumstances:

  • Attempts to repair by unqualified individuals.

  • Commercial Gas Equipment must be installed by a qualified Gas Safe Registered Engineer. Failure to do so will void the product warranty.

  • Hardwired Electrical Equipment must be fitted by a qualified Electrical Engineer. Failure to do so will void the product warranty.

  • Installation or usage instructions (either written or verbal) have not been followed.

  • Misuse of equipment, wilful damage, negligence, abnormal working conditions including lack of cleaning or poor ventilation and user error.

  • Goods are outside the manufacturer’s timed warranty period.

  • The fault is not covered by the general manufacturer's warranty.

  • Goods have not been regularly maintained and serviced.

  • Failure to use chemicals, cleaning products and other sundries specified by the manufacturer. 

  • Inadequate services to the equipment, e.g. power supply, gas or water pressure.

  • If the warranty claim is for an item that is excluded from the warranty e.g.

    • Bulbs, Glass, Door Seals, Pizza Oven Stone Deck, Charcoal Coals, Switches, buttons, blades, gaskets, filters, locks, keys, toaster elements. Knobs, Handles and Hinges. Normal wear and tear to consumable parts.

Force Majeure

Neither party will be liable for inadequate performance to the extent caused by a condition (for example, natural disaster, act of war or terrorism, riot, labour condition, governmental action, and Internet disturbance) that was beyond the party’s reasonable control.

 

Limitation of Liability

Fusion Catering Solutions and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from you use of the Site.

Indemnity

Except where prohibited by law, by using this Site, you indemnify and hold harmless Fusion Catering Solutions and our directors, officers, agent, employees, subsidiaries, and affiliates from any actions, claims losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Country of England.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes 

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users of changes to these Terms and Conditions BY posting a notice on our Site.
